DUI charges dropped against Federal Prosecutor

Assistant United States Attorney Gerard Sullivan was arrested over thanksgiving weekend and eventually was charged with DUI and refusal to submit to a chemical test.  The final disposition of his case resulted in a plea to the refusal charge and a dismissal of his DUI charge.  This is an extremely common disposition that is generally available with all police departments in Rhode Island so long as there was not an accident, it was a 1st offense and the defendant acted appropriately during the arrest and booking.  It should be noted that recently the RI Attorney General’s Office has moved away from offering this disposition and will now only offer as a plea a dismissal of a breathalyzer refusal charge in exchange for a plea on the DUI charge. The only difference between AUSA Sullivan’s case and that of the average citizen is that Sullivan’s was played out on the front page of the news.
