What is Larceny ?
Larceny is the act of stealing/theft of any item
of property, goods, or money. Under the laws of
Rhode Island, related categories of larceny
include theft, shoplifting, embezzlement,
misappropriation, unlawful appropriation,
insurance fraud, receiving stolen goods, and
false pretenses.
Penalties For Larceny under
RI Law
If the items stolen are valued at under
$500, the penalties for misdemeanor
larceny is:
- up to a year in jail
- fines of up to $500
If the items stolen are valued at over
$500 or is a firearm it is a
felony larceny charge, with penalties
of:
- up to 10 years in prison
- fines of up to $5000
If the victim of the larceny/theft is over
65, the penalties are increased to:
- 1-5 years in jail, and fines up to $3000
if the value of the item(s) is under $500
- 2-15 years in jail, and fines up to
$5000 if the value of the item(s) is over
$500
The Crime of attempted larceny
carries with it the same penalties as if the
larceny/theft was successful.
If you are convicted of larceny, shoplifting,
receiving stolen goods for a third time (3rd
offense), you will be considered a
habitual offender and face a minimum
punishment of $200-$500 and a mandatory 6 months
to 1 year in jail.
