(within Five Years of previous offense) with a BAC between
.08-.15%
- Felony Charge
- $400 Fine
- 1-3 years in jail
- Two to three years license suspension
- Alcohol/drug treatment program

- Ignition interlock device for up to 2
years after sentence is completed, when
license suspension is over

Offense RI Drunk Driving with a BAC of .15% or Higher
- $1,000-$5,000 Fine
- 3-5 years in Jail
- License suspended for 3 years
- At the discretion of the judge the
violator's vehicle may be seized/forfeited and sold by
the state
